A friend came to me asking to work with him around an idea he had. My role was software developer and he would create the business machinery around it. This did no went well at the beginning and we had to bring a third party to the company. We ended up creating a company and things went slightly better (we got few customers but revenue is quite low and can't even pay a quarter of a salary) but after few years I am tired and I feel I have invested too much time and effort on this and it hasnot' paid off. I asked the partners to leave because I would like to continue myself and they asked for the source code.
I built the code alone in my free time after work and putting my own resources (laptop and internet costs) and I don't have NDA. In Australia law says that company owns the assets so I cannot treat company property, assets or funds, as if they are your own.
My question is (considering my situation):
is the source code an asset of the company or only the binary files?
